The honest facts are that many if not most of these cases are settled outside of the court. On the flip side the doctor or hospital is not going to want all the negative publicity that will come from the suit so they will more than likely only want to settle so that they can go on with their practice without many people knowing what happened.

The question with this becomes is this good or bad? It's always good when two people can settle their problem without the court, but wouldn't you want to know if the doctor you went to had a malpractice suit against them?
