If you find that it was on accident then the course is a little bit harder while sometimes a person can file a suit and will win there are just as many times when a person files in this case and doesn't. Just because a doctor fails to notice something on your file doesn't mean that you will win your suit, so this is something that you need to make sure that you understand and talk to a solicitor before you make any final decisions.

The honest facts are that many if not most of these cases are settled outside of the court. The reason is that for many people they find that if there was wrong doing they want to get their compensation and then simply move on, they don't really want to have to go through a hard and long process with courts. On the flip side the doctor or hospital is not going to want all the negative publicity that will come from the suit so they will more than likely only want to settle so that they can go on with their practice without many people knowing what happened.
The question with this becomes is this good or bad? It's always good when two people can settle their problem without the court, but wouldn't you want to know if the doctor you went to had a malpractice suit against them?
